Terms of Service

1. Acceptance of terms

By accessing or using offduty (“the Service”), provided by DiscoveryCo (“we”, “our”, or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users of the Service.

2. Description of service

Offduty is an email batching service that connects to your Gmail account via the Google Gmail API (OAuth 2.0) and holds incoming messages, delivering them to your inbox on a schedule you define. The Service includes:

• Scheduled email delivery to your Gmail inbox
• Do not disturb periods and VIP sender exceptions
• On-demand delivery and temporary hold pause
• Support for multiple connected Gmail accounts

3. Account registration

You must sign in with a valid Google account to use offduty. By signing in, you authorise offduty to access your Gmail account as described in our Privacy Policy.

You are responsible for maintaining the security of your Google account and for all activity that occurs under your offduty account. You must be at least 13 years old to use the Service.

4. Free trial and subscription

Offduty offers a 30-day free trial. No card details are required to begin a trial. After the trial period, continued use of the email holding features requires a paid subscription.

Subscriptions are billed monthly or annually as selected. Prices are displayed on the Pricing page and in the app. We reserve the right to change pricing with 30 days' notice to existing subscribers.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide pro-rated refunds for partial periods, except where required by law.

5. Acceptable use

You agree not to:

• Use the Service to violate any applicable laws or regulations
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use the Service in a way that disrupts, overloads, or damages our infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Share your account credentials or allow others to use your account

6. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that all emails will be delivered on schedule.

Email delivery depends on the availability of the Gmail API and your Google account. We are not responsible for delivery failures caused by Google service outages, changes to Gmail API behaviour, or revocation of OAuth access.

7. Limitation of liability

To the maximum extent permitted by law, DiscoveryCo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to missed emails, delayed communications, or data loss. Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Termination

You may terminate your account at any time from the Account page. We may suspend or terminate your account if you violate these Terms or engage in activity that could harm other users or the Service.

Upon termination, all held emails are released to your Gmail inbox immediately, and we will revoke our OAuth access to your Google account.

9. Governing law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before any formal proceedings. We will always try to resolve issues directly with you first.

10. Changes to terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance. The “Last updated” date at the top of this page reflects the most recent revision.
